On January 27, 2021, CBP issued CSMS #45967303 – United Arab Emirates Section 232 Aluminum Absolute Quota limits beginning February 3, 2021, which is provided below:

The 2021 Section 232 United Arab Emirates Absolute Quota Aluminum threshold is announced on Quota Bulletin QB 21-701A at: https://www.cbp.gov/trade/quota/bulletins

All entries submitted From January 1 through March 31, 2021 will count towards the Q1 quota limit.  Entries as of February 3, 2021 must utilize HTS 9903.85.06 through 990385.08 to access the quota.

Effective February 3, 2021:  Presidential Proclamation 10139 (https://www.federalregister.gov/d/2021-01711) establishes guidelines for annual duty-free quota limitations on aluminum imports from UAE. 

Any imports of aluminum articles from the United Arab Emirates that were admitted into a U.S. foreign trade zone under “privileged foreign status” as defined in 19 CFR 146.41, prior to 12:01 a.m. eastern standard time on February 3, 2021, shall not be subject, upon entry for consumption made on or after that date and time to the additional 10 percent ad valorem rate of duty imposed by Proclamation 9704, as amended, and shall be subject to the quantitative limitations established in this proclamation.  For additional filing instructions for such entries, contact the Trade Remedy Branch at traderemedy@cbp.dhs.gov prior to filing the type 06 entry summary.

Reminder:  Effective December 29, 2020 per FRN 2020-27110 all entries for General Approved Exclusion (GAE) HTS must utilize 9903.85.11.  The list of GAE HTS numbers can be found at the bottom of the Quota Bulletin.

In alignment with Presidential Proclamation 9740 of April 30, 2018 and Presidential Proclamation 9759 of May 31, 2018:  Quantitative limitations applicable to imports of aluminum products under HTS subheadings 9903.85.05 through 9903.85.06 for the quota year are limited on a quarterly basis.

As of June 1, 2018, CBP implemented absolute quota processing functionality in ACE.  Absolute quota is processed on a daily basis, Monday to Friday (excluding holidays), and cargo release of shipments subject to the absolute quota will be withheld until the absolute quota is processed and quota amounts are allocated. 

In order for shipments to be processed for absolute quota on the same day, the entry summary must be filed, entry summary payment date must be on file or scheduled for a future statement, and the conveyance arrived by 4:30 pm in the port of unlading’s local time zone.  The official hours for quota processing are established by 19 CFR 132.3.

All new entries submitted on February 3, 2021 prior to 8:30 am ET will be counted in the first opening at 8:30 am ET.  If the accepted entry totals for any HTS submitted prior to the first opening exceed the limit of that HTS they will be prorated.
