On August 13, 2019, the US Trade Representative (USTR)  announced the next steps on the proposed imposition of 10% additional duties on articles covered by List 4 (approximately $300 billion of Chinese imports).  Specifically, the announcement advised as follows:

  • Certain other articles are being removed from the final list based on health, safety, national security and other factors and will not face the 10% tariffs;
  • The remaining products contained in the May 17, 2019 list will go into effect on two different dates September 1 and December 15;
  • The articles included in the December 15th list include for example, cell phones, laptop computers, video game consoles, certain toys, computer monitors, and certain items of footwear and clothing.
  • The articles covered by the September 1 effective date are listed in List 4A, while those that are will be subject to the 10% tariffs on December 15 are included in List 4 B.

The USTR announcement said it intends to conduct a product exclusion process for List 4 products subject to the additional tariff and will publish in the Federal Register as soon as possible additional details and lists of the tariff lines affected by this announcement.
