On August 5, 2019, the US Trade Representative (USTR) posted an advance copy of a Federal Register notice announcing USTR’s determination to grant certain exclusion requests to the third list (the $200 Bn action) of Section 301 tariffs on products of China, as specified in the Annex to the notice. As with the first two lists, USTR will continue to issue decisions on pending requests on a periodic basis. The exclusions are retroactive to the September 24, 2018 effective date of the $200 billion action, and will extend for one year after the publication of the notice. U.S. Customs and Border Protection will issue instructions on entry guidance and implementation.
