The European Commission has launched a comprehensive evaluation of the EU’s Rules of Origin (RoO), which is the legal framework that determines the “economic nationality” of goods crossing
These rules play a pivotal role in customs classification, eligibility under trade agreements while also supporting broader EU policy objectives.
In response to shifting geopolitical dynamics and changes in the multilateral trading system, the Commission is assessing whether the current framework remains effective, relevant, and aligned with today’s global trade realities.
Understanding Rules of Origin?
Rules of Origin are a cornerstone, a pillar of customs legislation. They determine whether a product qualifies for preferential treatment under trade agreements or is subject to additional controls. Beyond traditional trade functions, RoO increasingly now intersect with emerging EU initiatives such as the Carbon Border Adjustment Mechanism (CBAM) and the Regulation on Deforestation-Free Products (EUDR).
Given the complexity of modern global supply chains and the emergence of new trade instruments, the Commission is undertaking a full-scale review to ensure the RoO framework remains fit for purpose.
Scope of the Evaluation
The review will focus primarily on non-preferential Rules of Origin, which apply outside the context of trade agreements. However, a comparative analysis with preferential RoO will also be included.
Key areas under examination include:
- The definition of country of origin
- Methods for proving origin
- Procedures for verification by customs authorities
The evaluation will address questions such as:
- Are the rules achieving their intended objectives?
- Are they unnecessarily complex or burdensome?
- Do they support current trade and environmental policy goals?
