On September 22, 2020, the Office of the United States Trade Representative (USTR) published in the Federal Register, a notice of product exclusion extensions from the List/Tranche 2 ($16 Bn.) action. The notice announces the US Trade Representative’s determination to extend 17 exclusions through December 31, 2020. US Customs and Border Protection will issue instructions on entry guidance and implementation. The exclusions are available for any product that meets the description in the Annexes to the notice, regardless of whether the importer filed an exclusion request. Further, the scope of each exclusion is governed by the scope of the ten digit HTSUS headings and product descriptions in the Annexes to this notice, and not by the product descriptions set out in any particular request for exclusion.

  • Annex A, Paragraph A subparagraph 1 establishes a new HTSUS heading/subheading 9903.88.59
  • Subparagraph 2 inserts a new US note 20 (lll) to subchapter III of chapter 99 in numerical sequence.

  • Annex B, which is provided for informational purposes only. It contains a table that lists the original product exclusions that are being extended and the corresponding subdivisions to new US Note 20(lll) and 9903.88.59.
